A man beaten by a North Carolina trooper during a traffic stop 23 years ago goes before an Industrial Commissioner in hopes of forcing the state to pay for his injuries.

The News & Observer of Raleigh reports Deputy Commissioner Wanda
Taylor is to hear arguments Thursday in the case of 50-year-old Richard Wayne Barfield of Wade, who suffered skull injuries.

State officials don't dispute trooper Geary Blackwood badly beat
Barfield outside a Fayetteville convenience store in 1985.

Blackwood was later fired.

A federal jury awarded Barfield $500,000 but Blackwood had no
assets to pay the judgment.

The state said it didn't have to pay because the trooper acted without authority.

Barfield's lawyer got state law changed to allow such claims.

The state wants Taylor to dismiss the claim. The most she can award is $100,000.

"Melissa." you sound like a very opinionated person and you have that rights. But have can you say an officer has he rights to put his/her hands on someone using force as necessary. They do when they feel suspicious of something or threaten. If that was the case than you will have complains all over the nation. they had just cause to fire this officer (probably because he did not have reasons to beat this man)for his actions. I don't think these people are claiming to be beating unless they have physical proof. Every CRACKHEAD is not a bad crackhead, just made bad choices.. But on the real side, you can't think that every office are straight by the books.

He should be paid. The cop was clearly wrong. Cops over react in some situations. Cops do have a job to do but taking advantage of a situation is wrong. Some are bullies that have the law behind them. If it was you or your family member then you would want justice. Wearing a badge does not give them the right to pick on people. Not all are bad but as the saying goes one bad apple will ruin the basket.

How is it that its always the law that is guilty. A cop does not touch a person unless the situation calls for it. if he tells you to do something , do it. If you dont do it the law can use force as neccessary. Im sick of all these scumbags trying to claim beatings when they themselves are the reason force was used against them. give the cops a break they have a job to do so let them do it, cause if you wont be dealing with a crackhead on that level you have no idea what its like.

Pay him. Any job that has a position of authority should always be mindful of his or responsibilities on and off duty. This officer should be held at the strictest level of the law due to his or her fault. Now, the state is saying no not pay cause of the maximum about is 100,000. so what your officer was at fault and under all the strictest test to join the trooper club you should be made to pay well over 500,000 for a skull injury.
